As consumers we pay for goods and services every day. What happens if you do not receive the quality products or services for which you paid. Do you have any rights? Yes you do. Whether it is a landlord who won’t return a security deposit, a contractor who builds and sells a defective home, someone who misrepresents an important fact in selling a product or providing a service, or a professional who does not provide the services that were reasonably expected, you may have grounds to pursue a claim. In Massachusetts, many consumer claims have the benefit of being subject to Massachusetts General Laws Chapter 93A, a consumer rights law. This law makes a commercial provider of goods and services who commits an unfair and/or deceptive act in providing the goods or services liable. If the unfair or deceptive act is willful the court can award double and even sometimes triple damages. The statute also awards attorney fees if your case under Chapter 93A is successful.
